She is forceing the judge to submit my salary certifictae

DEAR FRIENDS

1.DV AND 125 DISSMISSED IN JUDICIAL MAGISTRAT COURT AND APPEL ALSO DISMISSED.

2.BEFORE FILEING DV I HAVE FILED SEC9 AFTER SHE FILEING DV ,I HAVE TAKEN BACK MY SEC9 PETITION.

3.AFTR TAKEING MY SEC9 PETITION SHE FILED SEC9 PETITION 125 AND SEC 24 IN FAMILY COURT MAINTANCE TO HER AND DAUGHTER

4 NOW UNDER SEC24 SHE IS FORCEING THE JUDGE TO SUBMIT MY SALARY CERTFICATE  STILL JUDGE NOT INSISTED TO SUBMIT SALARY DETAIL'

5 BUT ANY POSSIBILITY IS TO AVOID SALARY CERTFICATE TO SUBMITING COURT OR JUDGE CAN INSIST TO SUBMIT SALARY DETAILS.

6 I HAVE SUBMITTED ALL HER QUALIFICATION DETAILS AND EARLIER WORKING DETAILS AND SUBMITTED MADHYA PRADESH COURT JUDGEMENT ALSO..

7 SHE IS DEMANDING ALMOST 80% SALARY

WHAT WAY I HAVE TO DEFENCE IN THIS SITUATION AND HOW TO AVOID SUBMITTING SALARY CERTFICATE.

8 IN HER OWN WILL SHE LEFT MATRIMONIAL HOME WITH OUT INFORM

She cannot force the judge to direct you to produce the salary certificate.  You stick strongly to your version and keep pleading that she left the matrimonial home on her own and that you are ready to take her back  even now.  donot succumb to her psychological and sentimental pressures enacted before the court.

thank u kalai sir i have filed divorce based on mental cruelty and desertaton, in my home town, she submitted transfer petition to high court to transfer case to her native to delay the proceedings diatance is about 40km from my native her native.

to avoid section 24  in her own will she left matrimonial home is it sufficient.

one more point is she is begging judge now i do not have job only 5 cent site in my name,

how to defence  any points please suggest.

why you do not want court to know the salary details?

She can file a petition u/s91 asking the employer to furnish the salary particulars through process of court.  She cannot ask the judge to allocate 5 cents of land on your name to her, there is no provision for that.  Do not avoid sec 24 petition, challenge it and get it dismissed.

If you don't give the salary particulers , then she will an application under section 91, asking your employer to furnish the perticulers.. But the court will not order 80% of your salary to be given.
