Shifting of office

Association of Rural Surgeons of India (ARSI) is a NGO. It was registered as a society in Shimoga, Karnataka where it had its office. Now the office bearers have shifted to Maharashtra. What is the procedure to shift the office to another state?

Dear Querist,

Your NGO must be registered under the Societies Registration Act,1860 and unfortunately, there is no provision in that regarding the change of registered office from one state to another perhaps, each registrar has to work in its jurisdiction therefore, registrar of one state do not have power to change the registered office of the Society. However, you can still follow the procedure envisaged under Section 9 of the Karnataka Societies Registration Act 1960, which might prove beneficial to you for new registration in the new state, the procedure are as follows:

1.Submit a proposition in writing through regd. post to the members of the society concerning the change of registered address 21 days prior to the date of special general meeting.

2. Convene a Special General meeting for consideration thereof.

3. The votes cast in favour of the proposition by members shall not be less than three times the number of votes cast against the resolution, which shall be also confirmed by a similar majority of votes at a second general meeting convened by the governing body after an interval of 30 days after the former meeting.

3. Every change in MOA approved shall be filed with the registrar within 30 days after successful passing of resolution.
