Should i choose ssc or graduation for ecnr in passport

hello, I made my passport through an agent 4 yrs back, that time i had no idea of ecr and non - ecr status etc

My spelling on my ssc , hsc & graduation marksheet has mistake of my fathers name so , he told me not to mention about graduation while submitting papers or else i won't receive passport 

Now i want to renew my passport , so to get ecnr status should i use ssc or graduation?

if i mention graduation will they impose penalty for not mentioning about graduation before?

or smart thing will be to go through ssc marksheet
