Our Society is under the process of re development.The developer has slapped a penalty of few Crores for not vacating the premises.26 members vacated in time.
At the out set I state that out of 30 members 4 members had delayed in vacating due their personal problems.The Developer had filed a petition on One Member in the Hon.High Court.
The case was adjedged in the Developer's favour after 6 months.
Is the Developer stance in slapping a penalty on the Society valid in view of the delay in vacating of 4 members.What are the protection clauses or cases to be refered.
