Society permission needed to sale our shops in the building?

Society permission needed to sale our shops in the building?

We have two small shops in a residential building. around 200sq. each. We have a registered society. Do we need society's permission to sale our shops to a bank/cooperative patsanstha in Pune?

yes you would be required NOC from the society to sell your shops. Regards, Advocate Rohit Dalmia 9324538481 Mumbai

Thanks for info sir. But, If we sale shop without society permission, what would be consequences?

We have already sold our shops. What should be we do now?  Whether society has any right to object if we sell the shop to a patsanstha? On what grounds they can object it?

Per my knowledge society permission is only taken to see if you have any issues like mortgaged/pledged the said flat to any institutition or stood surety for someone or if any dues are pending, no claim by other legal heirs; if you are not having any such issues, then the society should not object to the sale of your shops even though you have sold the same without NOC! Only you will need to give an indemnity bond to the Society to indemnify them against any future legal issues cropping up which they do not know at this point in time!!
