Statement under 161 as evident in another related case .

CAN THE STATEMENT RECORDED UNDER CRPC 161 IN A CASE WHERE JUDGEMENT IS OVER BE PRESENTED AS EVIDENCE / CONTRADICTION IN ANOTHER CASE WHERE THE ACCUSED IN THE PREVIOUS CASE BECOMES THE COMPLAINENT IN RECENT CASE.

Yes 161 statement can be used in other cases as well.....and significantly the bar on admissibility of 161 statements - is not attracted when used in other cases.

I AM REALLY THANKFUL FOR THE CLARIFICATION w.r.t. MY QUERY ABOUT USE OF STATEMENT UNDER CRPC 161 IN ONE CASE AS DEFENSE DOCUMENT IN ANOTHER CASE.I SLEPT WELL YESTERDAY.

CAN YOU PLEASE PROVIDE ANY       ANY PRECEDENCE REFERENCE OF ANY HIGHER COURT WHERE SUCH CASE HAS COME UP                   AS MY CASE IS BEING TRIED IN A CJM COURT AND IT WILL HELP ME IMMENSELY IN SPEEDY                              TRIAL.

The statement u/s 161 can be used to contradict the witness in all cases.
