The status will be as a tresspasser .As 40 years he is enjoying peaceful,uninteruppted ,with the knowledge of the owners he may go for factum of possession plea.

Thank you Sir, Actually my dad had paid for the garage to the builder but i dont have any documents as he has passed away and i received this property due to a reg. will. How do i proceed with what you had stated Sir
