Streedhan legal heir

sir

my husband pledged 100 soverigns of my jewellery in a private bank in his name and he passed away this january. when i approach the bank to change the loan account in my name they insisted to get the concurrence of my in-laws who already claiming half of the share in everything and fighting with me and they will never give NOC to change the loan account in my name. i dont have any proof that it is sthreedhan.

1. what should i do now to recover my ornaments

2. can i file any suit ? if any under what section ?

3. how long it will take if i file any suit as iam paying monthly interest which is an additional financial burden on me

pls suggest me

Dear Client, 

Your father in law can not claim half or any share out of the property of your husband unless the property is co owned by him.

You apply for the legal heir certificate in the civil court along with the death certificate of your husband and on that basis make a claim of the ornaments and other of his properties as you yourself is admitting that you can not prove it as a Stridhan. 

Only dependent parents can claim for the maintenance out of the son's property not a share portion out of it.
