Suit for declaration

Dear sirs, can I file a suit for declaration in civil court for declaring that the defendants( who have committed crime) are liable to pay me compensation for the criminal acts they have committed on me

should I have to pay court fees at time of filing suit or can I pay at time of decree

because an advocate advised me that I can file declaratory suit declaring that defendants are criminals by paying very minimal court fees and ask for compensation

in declaratory suit for compensation against government officials should I have to array a retired officer who committed the wrongful act or should I have to array the current officer.
