I am taking this privilage to ask this question to the experds of the LEAGAL AREANA here. Actually one of my friend is an employee of the FOOD SUPLY OFFICE (permanent) under GOVT OF WEST BENGAL. But most unfortunately there was a matrimonial dispute between him and his wife and as obvious his wife lodged a writeen complain before the Police and Police started a case u/s 498(A)/506 of IPC R/W Section 3 and 4 of DP ACT and his misfortune is that he was arrested and sufferred judisial custody for 14 days before the investigation ended up in chargesheet and he was allowed bail. Now the point is as he is willing to join his service the office boss is asking any decission of SC that if a person is behind the bar for more than 48 hours he need not to be suspended or his suspention on merely that ground will not be proper. If you experds and my Ld friends and respected senior colliges can refer me any of such decissions it would be very helpfull for me as my friend is really willing to rejoin his service other wise he will be real short of options to survive as he is the sole bread earner of his family and beside him needs to maintain his old parents. Any of your reference and suggestion will be highly appritiated. Special note is that the authority has verbally given him the time upto 9th day of this month to submit a copy of such decission.
