Tapping of telephone by family members

 The learned Amicus Curiae has also submitted that nobody, whether a member of the family or otherwise, has any authority to tap the telephones of any other person, particularly without his knowledge. He submits that it is not only violative of Article 21 of the Constitution of India, but is also violative of the Telegraph Act. In this connection, he has submitted a judgment of the Supreme Court in R.M. Malkani v. State of Maharashtra . In para 30, the
Court held:
30. ...Article 21 was invoked by submitting that the privacy of the appellant's conversation was invaded. Article 21 contemplates procedure established by law with regard to deprivation of life or personal liberty. The telephonic conversation of an innocent citizen will be protected by Courts against wrongful or high handed interferenc

But one shameless member on this forum brazenly advocates the legality of installing spy cameras by husbands in bedrooms and even toilets to prove the case against wife.

Why cant it be the other way round . Why cant a wife install spy cameras in the bedroooms and even the toilets to prove the case against the Husband Or should i say how would the wife prove cruelty and domestic violence which takes place inside the four walls of the bedroom and a few  people  in this foroum with the designation inscribed on the walls of the foroum... Supreme coat ( not Court ) r/w High Coat ( Not Court )  say its difficult to prove but yet they go on instigating female members to file DV cases and 498 A cases even though no violence has taken place and neither dowry has been demanded . And as a matter of fact the cottage industry of our courts is over burdened with the flow of false cases and has never gone into recession although the world faces recession in different sectors :P.

Now can you tell me isnt the  DV act violating article 14 of the indian constitution .

Isnt this law gender Biased .??

why only the mother can have custody in this law  and there is no provision for the father ??

Dont you think this law Should be changed and the term women should include spouse ?? 

When the law is biased how do you tackle it ,can you provide a solution ??

i wish for your answers to open a debate ;)
