Tenant not vacating and causing trouble

We have a property in Tamil Nadu, India. We rented it out to someone who we thought were family friends in 2001. We have decided to sell this property and have been trying to vacate the tenant for more than an year now. In September 2015, he gave in writing that he will vacate this January.

He has kept on postponing this move since, and now he has filed a petition for interim and permanant injunction in the municipal court saying we are threatening him. He is denying that it was he who gave the letter and has been changing his story everyday. This has become a big headache. How do we get out of this mess?

A. As per the Supreme Court Judgement, that tenant shall be evicted if leased/rented premises is required for land lord's own usage during the course of agreement by giving prior notice.

B. In your case, you had to issue a legal notice and file a Suit for eviction before the court to evict the tenant.

C. Now, you can issue a legal notice and file a suit for eviction.
