Things to check when buying residential property

I would like to know what are the major things to know or legal documents to check when buying a residential property / flat/ apartment

Occupation certificate from the builders,1. the title of the property, 2. whether the ownership is that of the individual or that of a joint family, 3. whether the property is free of all encumbrances like mortgages, chargesetc., 4. whether the property,  if land, is within the ceiling limit.5. Non-encumbrance certificate from the Registration Department and also to persue the title deeds. It is buyer's duty to see the documents and in case he finds any complication in its particularly with regard to the joint family properties it would be essential to get them examined by a lawyer.

Could you please elaborate and explain on the following points that you indicated:  "Whether property, if land, is within the ceiling limit" and " Non-encumbrance certificate from registration department"

Apply and get an encumbrance certificate at least for 13 or 15 years, from the office of the Sub-registrar where the immovable property is situated. Gove the particulars ofthe property like Survey Number, extent of land, name of the village, name of ward, boundaries, etc. and specify the period for which you require the encumbrance certificate. 

The encumbrance certificate will show the details of registered documents relating to the property, Like sale deeds, mortgage deeds, etc.,

If there are no such registered records relating to the property the encumbrance certificate will be a Nil Encumbrance Certificate.
