Dear Akumar,
After going through your query, I understand your concern regarding the license for starting your legal career as an advocate. Here I am to provide you with some bits of advice that might help you out.
Anywhere in the world, holding a law degree is such a big task and firstly I would like to congratulate you for the same. But still, I feel sorry to say that in some jurisdictions, just having a law degree is not sufficient enough.
And since you are Indian, you have to appear for the respective State Bar Council Exam, as per the provisions of the Advocates Act, of 1961, and then only you will get your license for practicing.
Some other certain conditions are required to be eligible for enrolment as an advocate. For your convenience, I am listing all the necessary conditions here, and let me tell you that these are mentioned under Section 24 of the Advocates Act of 1961. Here you go:
1. Law degree, whether it is of integrated or normal course, from a recognized university.
2. You must apply for enrollment with the State Bar Council.
3. You must clear the All India Bar Examination (AIBE), as it has been made mandatory for those who aspire to practice as an advocate in India. This exam tends to examine whether the candidate has enough knowledge and understanding of the law.
I hope you are very familiar with the concept of case law, and here I would like to provide you with a case law. In the case of V. S. P. Venkatesh v. Bar Council of India (2010), the requirement of clearing the Bar Council exam was upheld, stating the fact that the exam ensures the spirit of competition among the candidates, aspiring to be the lawyers of the Country.
Hence, I would like to suggest that you must start preparing for the examination as this is going to be tough enough.
I hope I was able to make you understand the concept, if you need further clarification, then please feel free to connect with me on LinkedIn. ( www.linkedin.com/in/pankhuri-rastogi-9221b2289 )
Thank You.
