As your father died all his legal heirs i.e. his wife and children have equal rights over the property, divide the property into 6 shares (mother and 5 sons) and register the partition and sell individually or jointly. otherwise, file a suit for partition.

The facts posted by you suggest that your father had made an agreement to purchase land from someone who is stated to have been died leaving behind widow and five sons. One of the sons is not willing to sell his share, is it so ?
If so, your father may purchase 5 out of 6 shares of the property and get it registered.
