Transfer of flat in chs

is tanesy by entirely is applicable in mumbai. if the flat was purched by a husband & wife and they fulfil all requirment for tanancy in commen.  is not clearly writen that they are husband & wife  in agreement and also not mensioned that they  are tanacy by entirely.can we proove it tanancy by entirely and transfer a flat in one of them if one them expires.

Your query is unclear.

If husband and wife have purchased the flat, then they cannot be tenants, they are joint owners.

If the flat is in a co-operative society, then each of them will be owners of half the shares of the flat and each one of you can make a will or nomination as to whom the shares or flat ownership will be transferred.

You can also nominate or will their own shares to each other so that after one of the owner's demise, the other becomes the owner of the full flat.
