My friend has property which has been gifted by his father in 2007 by a transfer deed.
His brother and brother's wife has been staying there since 1998 in a room in that property. My friend asked them to vacate after transfer, they requested some time and now in 2011, my friend wife filed a DV case against her husband, husband's brother, and his wife seeking residence order?
Now my friend's brother filed evacuation suit in civil court against both his brother (who is not residing there now) and his wife. My friend has many severe ailments and now thinking to transfer the house in the name of his house by gift deed.
Can my friend transfer the property while the case is pending in the court?
