Unsecured loan default of deceased

HI All,

Location:Moradabad, UP

A relative of my had a business and had taken a Unsecured loan from PNB for same for 2L INR

He suffered losses in business due to fire and died 1 year later due to chronic disease.His wife was the guarantor of the loan.

The deceased did not pass any kind of asset to his wife and she is living in a rented house and surviving with a petty salary of 4k INR. She was paying to bank 2k per month towards interest but stopped it after June 2018. the bank declared the loan as NPA and then sent it to tehsil for recovery.

Now she is hounded by recovery agents who are asking for there fees of 25k Inr apart from loan repayment.

the agents claim to be from tehsil but there identity has not been verfied yet if they are from tehsil or private recovery agents.

From the above circumstances, can anyone suggest the procedure for resolving this?

Also does this case make the wife of deceased a criminal due to unability to pay.

The Lady is Guarantor to the loan. Banks do not just like that accept the Guarantee of a person without verifying the antecedents and the assets in his/her name. Therefore, Bank must be having proper details of the assets in the name of the Lady who stood Guarantee for the loan taken by her Husband.

 

Banks invoke the required law prevelant in the area of operation and they are well within the law.  However, harrassment by the Recovery Agents is something which needs to be looked into. It is always better to deal with the Bank directly and find out the present position and offer a compromise amount to settle the matter once for all.
