Want to file case against fraud builder

Hi,

I had booked a flat two years ago, but still the builder is not showing any signs of starting the construction. Also the plot he had showed to us is not on his name and came to know only after enquired from CIDCO. Now I want to take legal action against him. Pl help how to porceed as Police is not showing ant interest in case.

Sir/Madam,

We have booked an apartment situated at Kapra, Sinikpuri, Secunderabad. The one of the in charge is at the site office along with a team of Marketing People’s. When we went to saw the building we first met the in charge of the apartment and he asked us to discuss all the details with their marketing people and finalize the price.

We met the Marketing guy and discussed about the price and got all the relevant documents of the building from him and after verification from our end we proceeded , as per the advice of the builder we approached them and paid 15 % as advance and entered into an agreement, then there was correction in that agreement, we asked for corrections , they said the builder is out of station after the builder comes we shall do that, till now they have not corrected it, and then we said them to refund the money what we have paid, they said that they will pay us today, but today his mobile no is switched off.

It seems that the marketing person has not been paid the salary by them for a long time by the builder, so there seems to be problem between them. When we contacted the builder he said come to office along with the Marketing person to solve the problem, because of the problem between them they are not meeting directly with each other in person, but there is a communication between these two people’s regularly. When we sat and discuss these with the builder they are conforming the above said things.

So that we need a solution for this to get our money back from them.

Mr.Santosh,If you have sufficient proof or evidence on alleged fraudalent documents adduced by the builder then proceed against the said builder, with concerned jurisdiction police and if they refuse to file FIR, escalate the same to the concerned higher authorities police and if you are still deprived of rights ,you can file private complaint with the concerned jurisdiction magistrate. If you have valid agreement in place and if you are skeptical about criminality involved you can proceed with suit for damages or deficiency in service ( consumer court).
