Want to register marriage keeping maiden surname

Hi all,

My sister got married on last November 2014. now she applied for registering their marriage as per Hindu marriage act. but she want to keep her maiden surname but her lawyer forcing her to use her husbands surname. and after a little debate her lawyer told her if she can show any amendment or something which gives the liberty for women to keep their maiden surname then he will definitely do that. so guys can anyone please give any writeup or link or anything that i can give my sister where it is written clearly that bride can use only her maiden surname when applying marriage registration.

In application form she has to mention her maiden name.

You can retain your maiden surname while registering marriage and another thing is u can do the registering procedure urself.

Thanks a lot Mr. adv. Rajeev and Mr. saravanan.s. However i would like to have some authorized documents where it is mentioned that the bride can use their maiden surname (not in bracket). any amendment or notice or any judgement..anything. please.

in my view no such amendment was passed by the law commission

but it is only understanding between the couples to keep their maiden name
