What are the ways to delivery the summons?
Husband is lingering the case and here the judge is not interested in issuing any order to substitute way of delivering the notice. The case goes this way.
Sept 2015- Case Filed from gujarat to delhi. Summons served but as it was in ordinary post acknowledgement didnt returned back. Checked with the register of the court of Delhi, they saying that they have served the summons and sent it back via ordinary post and in between it is lost.
Jan. 2016- Sent through RPAD but returned back with vague remark
Feb.2016 - Sent through RPAD but returned back with remark "Respondent do not live there"
April-2016 - Sent through RPAD but returned back with vague remark (Newspaper publication application given but rejected by court.)
May-2016 - Court Order to send it through court i.e from gujarat court to delhi court and delhi court will serve it but the summons is not yet reached the delhi court. Inquired with delhi court they saying that they have not received any thing.
June -2016 - Court said to wait to any acknowledgement to come from delhi court. (Newspaper publication application given but rejected by court.)
July - 2016 - this is couple of days back. (Newspaper publication application given but rejected by court.) Court saying to wait till the acknowledgement comes back.
I am now fed up. Court is very lazy and do not order for any subsitute service of summons. Days are passing by like this only. The first one which is served is lost and the court official maitaining register denying to give anything in writing about the acceptance of the summons but do accept the fact that the summons is served.
I requested the lawyer to request the court to send it through balif but my lawyer is saying that she will reject it too.
Lawyer is also saying that court will never give it in your hand to get it delivered.
What to do now? Next date is in august end and I think that the summons sent by court will not be returned back as it never reached there. Again I will give the application and will be rejected by court and again next date and again next date.
Judge is not passing any order. The RPAD sent in January has also been manipulated. It shows the status delivered and then the next day respondent did some setting with postal department and that entry of delivered has been changed to undelivered. I do have print out of both the things i.e. the entry showing delivered and the next day entry showing undelivered. I presented this fact to judge too, she says k the get the stamp from the post office on the printout of the manipulation you had and I wil order for the newspaper publication. I rushed to the post office and get that stamped but when I returned back to court around 4 and shown the stamp to judge, she changed her mind and didnt order anything.
What should I do now. It is taking hell lot of time unneccesarily.
P.S. I recently did RTI to the delhi court asking about the details of the summons served. I sent the RTI from Speed Post. 10 days passed and the speed post status is not moving ahead as it shows some maintenance work is going on in speed post department. I am worried whether it will reach there or not. Even if it will reach there I am worried about the lethargic approach of the government officials. I do not have trust on any of the government work now.
Suggest me the steps to be taken by me from now on. I want to be aggressive and want to finish it off. I am even ready to bribe any official to get the truth of my part on paper. I am fed up now.
