Who can be an enquiry officer in a departmental enquiry

IN A DEPARTMENTAL ENQUIRY OF A PRIVATE SCHOOL AGAINST A TEACHER OF THAT SCHOOL, CAN THE SCHOOL APPOINT A LAWYER TO ACT AS THE ENQUIRY OFFICER??

SO WHO CAN BE THE ENQUIRY OFFICER????

PLEASE ANSWER ME AT THE EARLIEST...

In departmental enquiries, the departmental officers will be appointed to conduct the enquiry..In normal courses outsiders are not entrusted with the job of enquiry. Yet, there is no bar to appoint lawyers for the purpose.

Any person who doesnt have a personal interest or bias in the matter can be appointed as enquiry officer. A lawyer can very well be appointed as the enquiry officer.

If a lawyer [or a legally trained mind] is employed as an Enquiry Officer, then the employee can have the assistance of a lawyer to represent him.

Dear Student:

A person who is independent like a lawyer can be appointed as a Enquiry Officer in the Departmental Enquiry.  So he can be grant reasonable opportunity to defend the delequent employee and he can be impartial and non-bias.

Depends upon what the Classification, Control & Appeal Rules of the concerned department prescribes. Mostly, a departmental official/officer senior in rank of the accused is appointed as inquiry officer. If the lawyer is not an outsider and is an employee of the department, he can be appointed as an inquiry officer.

I do not agree that if lawyer is IO, then accused can be defended by lawyer.

 

On the contrary if PO is lawyer thenaccused can be defended by lawyer as a matter of court.

 

Even if the Io is just matriculate still if the matter concerns complicated legalities he can apply for being defended through lawyer.
