Renuka Gupta ( Gender Researcher )     22 September 2010

A gender researcher has explained what she meant by pro woman judgement. In some threads she has also explained that Equity  is a process to reach the goal of equality. This process takes into account the socio cultural, political and historical contexts. And a gender researcher also talks about substantive rather then formal equality. Equality cant be realised unless equity concerns are integrated in the structures of society.

I anyways do not take any comment personally. My reply is a general one and not directed to any particular person. I need not profess about my quality of research and worth of work I am doing. Mine may be a drop in the ocean and as a researcher I know it is an ever learning process.

1. Show both sides of the coin as politiolegal correct professment. For a Gender Researcher when ‘confronted’ each and every words of further repliers becomes “bulling” and /or “public forum abuse” and/or as a “personal attack” statement and it is a lame excuse to "end" a public platform debate hands up whereas all public replies were meant as a simple legal debate.

2. Absolutely.

3. Gender Researcher ever wondered why your started below message thread of
16 Sept. '10 with Title "Food for thought" which was put under Family Law Forum got deleted by Admin. / Partner of LCI Forum before it could be further scrutinized by 83+ K LCI members; since it contained one sided societal biasness and in Admin / Partner of LCI Forum wisdom it was rightly deleted before it becomes yet another issues between members after the last 3-4 months cold war between two sides of the coin wherein lots of members account were even deleted and some new faces popped up too from hibernation !

4. Any member may put as many citations / judgment as may be allowed by Admin / Partner but don't start the citation with a biased "quote" as is objected to Prabhakar's this post title. His contributing Judgment of Mumbai HC is OK to the extent it could be used by any deserving party accordingly, but, to put a quote in start of the citation is objection from one of the public member here.

@jamai of law:

I totally agree with you as far as this judgment is concerned.  It is not a landmark judgment and it is to be read in the light of facts and circumstances of this particular case.  Then the question raises that why it is posted.  Truth is not the monopoly of either men or women.  People lie. Liers cannot be differentiated on the basis of gender.  It has been continuously projected by some people that "women" (not some women) always lie when the matter pertains to interim maintenance or permanent alimony, custody of child or divorce. To  dispel that misconception, the judgment is posted.  If some women lie before the courts, some men also lie before the courts.  I conclude my response by saying that recently, one high court judge, who is ever cheerful in most trying conditions, said, in "return of cheque case", very sorrowly - "in these days before the court every one is lying".  If every one speaks truth only, believe me, even the most complicated case involving the intricate question of law, can be decided within one hour after pleadings are complete.  Cases will not run  for decades.

Fight for gender equality is a fight against odd/typical old type mindset which is still prevailing everywhere. So many things have happened, situation changed, era has changed, we have landed up on 21st century, but that ‘old’ and odd  type mindset still has many takers. And some are so egoistic that for them It is like “Rassi Jal Gayi,Lekin Bal Nahin Gaya”, social evils are vanishing but the same odd mindset is resisting the advancement/changes of our society.

 Once Mahatma Gandhi had said "First they ignore you, then they Ridicule you, then they Fight you, then You win". Just think over it, it is a great quote.
