Since you have decided to transfer the property in your mother's name, I will not stop.

Gift it to her.

T. Kalaiselvan, Advocate (Advocate)     04 February 2014

First thing is that donot hurriedly transfer your property on anyone's name.  If you find it is not possible to bear with her  any more, you may go for divorce against her on the grounds of cruelty.  Her frequent visits to her parents house and ill treating your parents and very hard and harsh behavior with you are clear grounds of cruelty and her unwillingness to live an amicable married life except for the sake of money or any material desire.  Let she file any amount of false cases against you, you may contest the same on merits from your side, be courageous, do not lose heart over petty issues.

Dear Vashisth Sir,

I have not decided to transfer the property,I am taking suggestions from u as it is the only thing i have and for it i have invested everything and still paying for it.

anil (officer)     05 February 2014

Dear Kalaiselvan Sir,

My parents can file case against her or i have to file cause i m working in gulf country and cant come to India otherwise i have to loose job and only source of income as my father is also retired.

what if she first file beating false case against me and also mahila mandal is with her, i have to come to India ?

I want suggestion regarding property transfer or not cause her father is collecting information about how much propertymy family have.

gautam (not disclosed)     05 February 2014

it is better to transfer the property, so that u can say that you dont have any assets

that would be looked unfavourably by the courts (malafide intention) and may pass a higher maintenance amount than warranted

once the couple embark on the path of legal recourse, then there is no trust left in the relationship and it is better to part ways

Dr J C Vashista (Advocate)     06 February 2014

I have clearly stated in my earlier suggestion, please read it again.

Do not hurry for transfer of property,, wait, nothing will go against the property acquired by you. Rest is your decision.

gautam (not disclosed)     08 February 2014

what if IRBM law gets passed eventually in a year or two.

then the property acquired by one will have to be shared, isn't it?
