Will

Can a Husband write a Will on his earnings / property / belongings for his childrens( teen age 15 & 13 yrs ) giving gurdianship to his  married brother /sister or ??? to restrict his wife from having any claim at any stage under any conditions since she has made the mockery of Indian marriage system to enjoy all she want w/out any responsibility / accountability . These types of woman can hire third party to kill the husband to have full property rights of hard earned money. What is the safe way to have an arrangement to debarr these types of ladies.  Even under Divorce they enjoy good protection to have maximum share.

Absolutely true. The wife is entitled for maintenance and equal share in joint property. She cannot raise any further claim on earnings and property of the husband.

Dear Querist,

 

She cannot lay any claim on your self acquired property - you can give the same to your children. Though your wife would remain the natural guardian of your children, but that hardly makes a difference because she cannot sell the property of the minor children unless the court sanctions it. If she attempts to do so - that transaction would be voidable - and can be challenged by children or your brother/sister as next friends of your children.
