presently where a women is subjected to cruelty by her husband or his relatives it is an offences under sec.[ 498 -a]undr this condition if a husband wants to meet their child  he can file a visitian suit in a court how can he bar from this.

Kindly see child rites through below angle;

1. If mother and father of a child fights on petty to grave issues then think aloud is it the fault of the child !


2. A father has as much equal rites to meet (visit) child whose temp. custody mother has and vice - versa. The more custodial parent allineats the chidl when matter in court the other parent pushes the issues more so ultimately the child suffers most out of the ego of parents.


3. A child can't be barred from the company (love and affection) of his natural father. A father is not 'seed giver" He has equal rites to care and nurture the sapling as much as the mother has.


4. Coming back to your main que. a mother should take efforts to allow visitation of child with father. Least she can press here is "supervised visitation" in the begining where she can be allowed to remain at visible distance and not hearing distance if she really feels with evidences that the child will be hurt physically and emotionally with such meetings (visitation).


5. Though even a hardcore criminal is not barred meeting his child during child issues before Court.


6. The more a child is allineated from either parent the more a child innocence gets lost.


A unbiased suggestion is to seperate mother / father issues away from "child welfare" when matter before Court. Let Court become "wise parent" if a mother and or a father is not able to take decisions on welfare of the child.


Last but never the least suggestion is think aloud is it right to bring a child to court environment means visit of court at such innocent age ?

I always find your posts very interesting and useful to read. I think this is probably because not being a lawyer, your do not have an "axe to grind" if you get my meaning. However, seeing how prolific you are, I do wonder when, if at all ever, you find the time to do medical value travelling, whatever that may mean. What is lost to the medical line is certainly a gain for the legal profession. Not only you give better advice than most lawrers, your spelling is also far superior. Just like there is alternate mediciine like ayurveda, there should be alternate lawyer system as well. Incidentally, where can one find such lovely blue sarees? Banares? Kanchipuram? Pochampally?

Most Hon'ble Vishwa,

Understood the direction of axe in some sweet place for some sweet peoples here and there part :-)


But, from all that I also understood the Font size 24 Bold color meaning too and I see a cloud looming very soon on my small head ha ha aha ............thks wish you too all the very best.


BTW that Blue suit (n not sari) is atleast not found in Scotland (James Bond avatar should have guessed so by now) is it not so Dr Watson :-)
