Agreement to sale- to take back earnest money

Dear Sir,

In case of agreement to sale, the purchasing party has paid earnest money but now not ready to purchase the same. The agreement contains the clause of return of earnest money by deducting 10% of the same. As selling party is not ready to refund the earnest money, the purchasing party wish to file suit for recovery of earnest money. Whether purchasing party can file suit for recovery of earnest money? Any other legal remedy is available for him?
