ancestral property tht falls inside the lal dora

my grand father purchased a land that falls under the lal dora(peripheri) and all his sons built houses on that land after the family members divided it among them equally.

one of my father's brother has sold his house to us through sale deed.(may 2010)..and thats under our possesion....

now can my cousin's(uncle's heirs) claim their share in that house.

if they file a case what shall be our position in the same

can property inside lal dora be challenged

pl answer as soon as possible

Dear Querist,

This issue essentially has four elements: (1) nature of land, (2) title to land of your Dad's cousin, (3) purchasers rights (your fathers) and (4) ability to challenge sale.

The fact that land is situate in lal dora (abadi or village periphery) will not in any way affect the ability of a party to challenge the same.

It appears that the land in question was ancestral and the same was acquired by your father and his cousins through partition.

Whilst your father had purchased the portion of your uncle through sale and your title may be legal and marketable, but the fact that this property was not a self acquired property of your uncle, the right of his legal heirs to challege the sale may be valid.

therefore it would be appropriate for you to consult a specialist on this issue and take expert advise and pre-emptory steps to safeguard your rights.

what is lal dora ?

Lal Dora refers to a red mark (outline) with which the municipal area is distinguished from village area. In Delhi this is a pratice that on all local land records boundries of various areas are identified throught this lal dora (red outline).

Land comprising of these lal dora are genrally village or old abadi land and fall outside municipal purview in tems of lvey of duties/taxe etc. Whilst there is no prohibition of sale transfer of such lands, however mutation of the same happens only in revenue records
