I have purchased flat in 2011. Till date builder has not formed society and intern conveyance deed is also pending. I sent him legal notice few months back in response he has pushed responsibility of not forming society on flat owners. And has said will do it in sometime and construction second building is completed.
Also would like to mention that flat owners in my society are reluctant to fight with builder over this issue.
I would like to understand two things:
1. Can I ask for bank guarantee from builder to mitigate my risks till the conveyance deed is done?
2. Can I go in consumer court and fight for my rights even if I don't have support from my society members?
