Builder mistake

Hi all,

 can any lawyer answer my question legally? please.. i explain. I have bought a row-house in a gated community from a known builder who had promised clubhouse and all but didnt kept his promise..

My row house has been fully paid, registered and also has Katha. I have 1 cm craks at the head of the verandah pillars after 3 years from delivery. my idea is that the whole verandah/porch block is sacking down, causing the pillars to break at the head joint.

shouldldn't be the builder held responsible? legally speaking? shouldn't the builder bare the repair and expenditure of it? is there any kind of guaranty for fresh contructions?. if it is a construction flaw of the buider shouldn't he bare the repair? -- as not only my house has same problem but all those that have a raised porch..


Please let me know if i can force him to repair it, as the builder is constructing a new group of villas just behind our compound!!
