Clarifications regarding slum clearance property

Dear Sir,   I have my father's property under slum clearance. My father gave half of the property to her sister to stay they also occupied that place. After her and my father's death. Her sister son saying that the whole property belongs to them. When we check in EC their name is showing and they showing some sale documents as if my dad sold the property, but when we went and ask in slum clearance they said property is still in my dad's name. Please let me know whether we can file case against them.

What do you mean by "but when we went and ask in slum clearance they said property is still in my dad's name.?

Has the said authority furnished you any documents or anything in writing?

Yes sir still property name is in my dad's name.. What they said means any sale deed need to be done from slum clearance board then only it is valuable.

Your father gave half of the property to her/his sister but how through registered deed or not?

Sir..the whole property is in my dad's name as per slum clearance board..the sold portion was just documented in 1000rs paper..authorities in SCB told us that its not to be considered..They prepared sale deed in 1000Rs Stamp paper and registered.

You file a suit for evicting your aunt's son from the property based on the title records you obtained from slum clearance board.

Let them object your claim on the basis of the documentary evidences in their possession, you can challenge the same on merits in your side

Thank you for your suggestion sir.

Slum property is governed by local (State) laws which cannot be sold without prior permission of Competent Authority.

Yes, Thank you Sir.

The entries in the records, in my considered view, stands at par with the entries in the Municipal Revenue records.  Such need not be absolute as to title to the property unless there are statutory laws provide so.

Where is the property situated?
