common property demolition

Ancestral land was shared among my father and his elder brother.

This land has 40 years old common house, which is shared by both.  We decided to construct house in our part.

We proposed the demolition of our share of the house. Intially he did not object.

After the start of demolition, he filed a case in court and got the injuction order.  Though no damage is done to his share, he claims 2lakhs compensation.

How to procede, plz help.

If you have any Deed of partition or some sought of documents that the portion in which you are constructing is allotted your share?

U make a partition deed with your brother and if he has agree with u, u can sign any document for new construction start in your part.

yes bharat,   registration is alreay done on my fathers name.  The opponent claims that semi destructed house will be a problem for him. He can not live in it.
