One of my friend is having a property in Janakpuri with an area of 170 sq. yard. He had constructed 2 floors (Ground, !st and 2nd) in 2004-05 amd had earlier made 1 room set on his 3rd floor. Later he sold his 1st Floor and 2nd floor and Now he wants to construct his 3rd floor fully. At the time of the 2nd floor, he kept the roof rights with him. The naksha is passed till 2nd floor.
Now he is in need of money and wants to sell the rights of 2nd floor roof, Please tell the following:
1. if the person who will buy the roof rights can construct full floor on 3rd floor based on his roof rights and if yes, how will its naksha will be passed further?
2. Can my friend sell the roof rights and get it registered?
3. As he had not made any parking earlier, will it create any problem?
4. If NOC is to be taken from all the owners of the floors, then what if anyone disagrees to give NOC?
