Criminal trespassing and theft

Dear Experts,

I am owner of a private limited company in Delhi. Its an HR firm

A person who is friend of one of my employee has come to my office nnd stole data from my network.

What can i do. It is captured in CCTV footage.

You can make a police complaint.

Do you have any proof that the culprit was related to your employee? What reasons did your employee give for quitting, if any? 

Make a complaint to the police under Section 43 read with 66 of the Information Technology Act. Put the erstwhile employee on notice under Copyright Act to desist from using your data. And try to discuss the matter reasonably with the employee, if any remuneration settlement or employment references are pending [wink].

If the person alleged to be friend of employee is captured commiting act of theft in CCTV footage then you can very well lodge a complaint againts him.
