cyber relationship

I am a Malaysian who had an online love relationship with an Indian citizen who is working in Dubai. Throughout our relationship we only communicated via SKYPE video conference call, online messenger chat, phone calls and sms but have not met in person. 

In between I have met his best friend who had assured me and my family that he take full responsibilty in ensuring that my marriage with my lover will go on smoothly. Now for a reason unknown to me both my lover n his best friend is avoiding me.

My family believing their words and ensurences have made marriage preparation. Now my lover refuse to marry me. 

Is there any law in India where I could charge them in court either under Cyber Crime or Forgery?

Please kindly help me as I am very depressed. I have all the nescessary proof such as the mobile sms, recorded skype calls and the chat history.

You can file a criminal complaint against the guy (lover) for cheating, etc....under the provisions of Indian Penal Code.

Dear Meena, Yes a case can be registered in India as well as in Dubai. In india a cheating & harrassment case can be registered. Further a complaint under Cyber act can also be registered both in Malaysia & Dubai

Only, if the place of offence occured in india.

For eg: you met his best friend in india and from india you've sent sms, calls etc.

File a case against the indian friend and his best friend in local police station u/s 103,406, and other provisions under information technology act .

Dear Meena

I can see so many lawyers assuring you that a case is possible, with their tongues hanging out for lucrative fees - no doubt they imagine Malaysians are loaded with cash. In point of fact, one can change one's mind about marrying a person, even after getting married one can get tired and seek divorce. I can understand you are depressed, angry etc and especially that you are seeking vengence - but not all life's problems can be solved by courts and lawyers (unscruplous vultures for the most part) I sincerely feel the best for you would be to move on with your life and try to find happiness elsewhere.

You are right in saying even a divorce can be obtained than a promise to mazrriage is nothing. but remind there are only few grounds to take a divorce and bored ot tiredness out of marriage is not the ground of divorce in any civiliged socities. Alimoney is also part of divorce there.

Its personel choise if someone forgive other but it is not good for socity as it will encourage the criminals to take advantage of this attitude of society. Thats why certain  criminal cases are non-cognigable. 

This club I think belongs mostly to inidan lawyers and they cant go to Malaysia or Dubai to file case, even place in India is also not disclosed so far and so question of charging or quoting fee doesnot arise.

If someone has money wit says he sould use that to buy necessities for him.

You are right in saying that person can change his mind so any one can change after hearing fee, there is no fee of window shopping so you should not be worried at this stage.

Deae Mr Vishva,

Thank you for you kind concern, however let me remind you that I am not here for the vengeance but JUSTICE. If every man can change their mind as their wish at a click of second than where is the value of the love they shared?

The least I deserve to know the reason why he refuse to marry me. Anyway I have filed a petition with the Commissioner of Police and also acquired a High Court Direction to the DSP of his parents residential district for an expeditious inquiry and the Judge ordered a case to be registered.

What worries me now is that despite having the High Court Direction, the SI of that particular Police Station still hesitant to file the case. It been more than a week since the SI consulted the APP where he ordered to give a receipt for my petition and they will week the Magistrate's permission to file a case under Section 417.

I am going to wait for another 2 days and if no case is registered then I will initiate Contempt Of Court. All I need to know now is that will the case stand having in mind that I have not met him in person.

This is not vengeance but a lesson to all frauds out there that you got to pay for your action one way or another!
