DC land cannot be registered in the name other than SC without prior permission of district administration
Section 42 (SC, ST Act) prohibits the sale of sc land without approval. This law was enacted to protect the interests of the SC/ST tribe.. This law was enacted to protect the interests of the SC/ST tribe. However, you can acquire SC land by obtaining authorization from the DM or the collector. If you are from the general caste, you would have to go through a lengthy procedure to obtain SC land.
If the mother was allotted with this land by government, she cannot sell the land to outsider without permission and that too immedaitely.
If the sale is beyond the restricted period then she can submit an application for seeking permission to sell the land to outside community people.
If not the sale is invalid and illegal.
If the sale is within three years, then a cancellation deed executed jointly by the seller and the buyer can enable you to retrieve the property.
otherwise the buyer can resell the property for the said reasons to the seller itself. .

Thank you sir for your info it was sold out 5 years ago to a non SC community person. I'll get more facts about it and post and keep posting here but it's seems without proper approval only she sold out. So if we take any action will it help us to get it back ( We will payback the money whatever they're asking).
