Deed of settlement

I`m from Kolkata . I had a 3 BHK flat (super built area 1300 sq ft) which is in my name and my mothers name. My mother is 72 yrs old sick widow. I have purchased the flat on my own but i also named my mother as coowner of the flat along with me. The corporation taxes, water bill, electricity bill, telephone bill are in my name only.

I have an elder brother. Now my mother wants to delete her name from the flat as coowner. Whats is the procedure for it. Shall my mother go for Gift deed to me or she will go making an Will. Which process is smoohter.

If my mother goes for Gift deed to me then how area of the flat she is eligible to gift me. Is it 650 sq ft or any other.

Whats the process for gift deed. How much registration, stamp duties are levied for gift Deed in West Bengal.

If my mother does the Gift deed to me then can my brother make any claim of the flat in future in my mothers absence.

Pls advice.

You need to have a proper drfated WILL and a Deed of Settlement among yourselves.
