Delayed promotion

I am a central government employee. I was eligible for promotion agains vacancy year 2011-12. But till 2018 the DPC was not held. Meantime in March 2017 I was issued a Charge sheet , hence departmental proceedings have started. Now the DPC is being conducted for fill up posts for vacancy year 2011-12 onwards. As I will not get vigilance clearance as on date. The delay in promotion will cause denial of promotion to me. Please advise what can I do? In the year 2011-12 upto March 2017 I was eligible for promotion and no case was pending against me.

I believe that you need to defend your case before the CAT.

There is no case of filing CAT case as on now.

 

Sinc ethe DPC is for the past vacancies and if there was no chargesheet on that date then the vigilance clearance annot be stopped.

Sir as per letter issued by the adminstration , they have called vigilance status as on current date i.e. June 2018 for all the vacancy years.(i.e. 2011-12 to 2017-18). Is there any rule/judjement which indicates that the vigilance status as on vacancy year shall be considered by the DPC.  Please reply
