divorce -sms contents

friends,

can a party to the divorce petition file application seeking to summon the sms contents prinouts of the spouse?

is it true that sms contents can be accessed only in criminal cases through police only?

do mobile companies save sms contents in their server? how long they are supposed to keep the contents in server?

kindly enlighten.

1. No, I mean to say that as per recent TRAI regulation / Circular post Amar Singh case only records that are accessable are of last 13 months call details of a customer which can be produced by witness list allowing either in a civil / crl. proceedings as the case in hand may be. You may ask for complete incoming / outgoing including SMS incoming / outgoign records with cell tower locations and see scanning those records thus produced what pops out !

 

2. SMS contents records if a customer has subscribed for saving in providers server then they can be accessed / produced that also of last 13 months otherwise forget getting even yesterday's SMS contents record if storing in providers server not requested by a customer as operators have stopped keeping them as part of their records.
