Employee bond

Dear Sir,

I am working as a engineer at my present company they have made me signed a 3year bond before joining 

the company stating that company will spend about 3  lakh 40 thousand on my training  and certifications

but after working 1.5 years with them they have given me training of only 2 days that in india and two certifications which cost 7000 rs  and they dont provide any employee benefits like bonus,incentive etc, they dont have pf system for emploee only salary now i have got job in reputed MNC with all employee benefits and perks i want to leave my current job and want to join  MNC  so what should be the procedure to do so should i go and give resignation before joining mnc.

my present company has not given me any  copy of my bond signed by me  ,i have signed bond on 100 rs stamp paper

kindly suggest me a solution

It shall be appropriate if you post the copy of appointment letter, bond, employee rule book, standing orders, and you may erase the names to maintain the confidentiality.

Company has to pay bonus, PF as per EPF rules, Bonus Act.

Incentive is as per incentive schemes. Policies announced by company, and are disbursed if the employee qualifies for the incentive.

Are you a confirmed employee? What is your designation?

Have you ever represented in writing, under acknowledgment, to the good offices of your appointing authority, MD, CEO, Head-HR, Company Secretary, that :

-benefit of PF, Bonus is not being extended to you, and you should be informed in writing why these schemes due to be extended to you are not being granted to you?

- the incentive schemes, policies may be supplied to you. (You can collect these from your colleagues also. By all means you should collect these and your sales register/target Vs. performance data, copy of your appraisals etc)

- And that company has made you to sign on a bond copy/certified copy of which was not made available to you on the spot and has not been made available to you till date despite your representations in person, causing you stress/anxiety, therefore the good offices should supply you the certified copy, so as to reach you, say within 7 days, by redg/speed post only.

Has the company mentioned in your appointment letter that you shall be entitled for PF, gratuity, bonus, incentives, etc.?

Or you shall not be eligible for the same, and has the company obtained any concurrence/agreement from you in writing to this effect?

Do you have the copy of employee rules, standing orders of the company? Has the company circulated these to employees or placed it on the intranet/ employee portal? You may obtain these as ap.

As per language of the bond posted by you, your liability is limited to Rs.7000/. Do you have the relevant record, documents to prove that the cost of training was Rs.7000/ only?

You should submit a gentle communication in writing under acknowledgment asking good offices,  for EPF, Bonus rules, incentive policy applicable in your company and your eligibility/ineligibility for the same, and to supply you the same along with certified copy of the bond. You may mention that till date company has spent only Rs.7000/ on your training and you have immensely contributed to the revenue, profit and performance of the company with the services rendered by you.

You should tender notice of resignation, as per termination clause, with effective date of resignation clearly written in it, addressed to your appointing authority, under proper acknowledgment and demand receipt of the same. Your line management and HR can play an important and useful role, therefore you should remain gentle, and maintain rapport.

Thank you very much Mr, Kumar for your reply,

In my company nobody get PF and that kind of employee benefits except mediclaim of rs 50000.

and i was allowed to give online exam  two times and i have acquired certification for that  the cost of first exam was 99 $ and cost of second certification was 30$ it is given on certification website and they send me to pune for 2 day training but that training was free for my company it was given by the company whose software our company sells.

There are clauses  i will write it for your reference

Service Period

You are expected to devote at least 3 years of dedicated service to the company.

Nature Of Employment:

The nature of employment is permanent however the management reserves the right to terminate your services during the probation period without any notice or any compensation in-lieu thereof and with one month notice or payment of one month salary in lieu thereof after your confirmation if you decide to leave the organisation at any moment you will be required to give one month notice or one month salary in-lieu thereof
