ExParty Decision

Hi,

Greetings for the Day!!!

We are in between of a Civil case. More than 4 months has been passed after serving after serving notice from ADJ Court. Still defendant has not directly appeared in court.

Can we appeal in court for Ex- Party decision now?

Hi Arvind,

Notice has been served successfully to both parties. In this case we have 2 parties(as tennat have 2 sons and tennant has dead)

We served notice to both of his sons.

Now Application in court from only 1 son has been put that is ill.

In this case can we raise request to give decision.

but i hope u hve appealed for an ex-party decision and it has been objected too by  the other party ??

send a remainder about the exparte decision by RPAD.  later the person cannot come and set aside the exparte order.

excuse me for my ignorance but what is aan RPAD ??? You mean Registered AD ?

when service is complete and one of the defendent does not appear the court can move ex-parte after reasonable waiting
