Gift Deed

 Hello Sir

I have the below question with resect to Gift deed

My father together with 5 of his brothers bought a piece of land in my home town and one of my uncle is  GPA now.

Now, all the 6 are planning to construct an appartment. My father wants me to construct the flat for his share and wants to gift his share of the property in my name. I have a brother and he is in Canada and became a canadian citizen(he holds canadian passport and doesnt have PIO card). When my father gives the gift deed does both my mother and brother needs give no objection

pls advice

The share your father holds is self acquired property of ur father and he is legally entitled to gift it anyone he likes. There is no requirement of taking a no objection of ur brother and mother.

If your father and his brothers purchased the self acquired property, according to hindu law your father is legally entitle to gift his share to anybody he desire and therefore no any requirement of taking NOC from brothers of your father, in the absent of any contract between your father and his brothers.
