Judgement regarding delayed notice

Any one kindly give any judgement regarding the above issue....delayed notice in 138 proceedings

Hi, How much is the delayed time? and what is the reason of delay? You need the judgement on the justification of specific reason for the delay.. any judgement might not be helpful for you. Adv. yes sir, the thirty days of sending legal notice starts from the day when bank endorses as 'in sufficientfund' and at   the same date they have given the  return memo. in our case on 16/2/15 the cheque is bounced and and at the same date the IDBI bank had issued the return memo in february totally 28 days but we have written date in the head of the notice has 16/3/15 but posted it through rpad on 18/3/15 it comes 31 days from the date of return memo... any judgement and citations regarding this issue  sir

the case is in judgement stage on 21/12/15 monday.the accused side counsel filed a 311 petition and argues that the petition is not maintainable due to one day delay in notice......regards l.k charles

Its really a surprise that NI ACT case has come to a judgement stage in 10 months of filing the case,normally it takes at least 3 yrs in lower courts.Judgement has been posted to 21/12, the accused has finished all his options and 311 is not maintenable now.he should have filed it in the initial stages itself.
