Land related issues

A piece of land s registered in the year 2006 in a sub registrar office by a private individual after following due procedure. Now the individual wants to sell it. But unable to do so as it is showing as Surplus land. When applying for patta, it shows as Govt land.  Non encumberance taken showing it as land registeted in the private individuals name only. What is the legal remedy for selling the piece of land rightfully owned by the pvt individual.

The property was sold to you by your vendor playing fraud on the basis of fabricated documents. 

However,  you verify the status of property from the land revenue department and ascertain the facts. 

After that you can take steps to file a suit for declaration of title on the basis of adverse possession.

The individual must have surplus land meaning thereby a cap on acquiring property.
