MCD Full Settlement Amount

In Mutual Consent Divorce, suppose a husband has given a hefty amount to his wife as one time and full and final compensation and its mentioned in the divorce petition, and after 6 months, wife doesnot come for 2nd motion or wife denies for divorce. Just want to know, in this case will court order her to return the money back or do the husband has to file some separate application for divorce or getting his money back.

Payment for MCD happens only on the judgement on signing MCD by both. Paying early will land up in prolongation of the matter

Thanks for replying. Yes I know that. Both husband anf wife filed a mutual petition in which payment is accpted by wife for full and final settlement. But my query is "If after 6 months, wife doesnot come for 2nd motion or wife denies for divorce. Just want to know, in that case will court order her to return the money back or do the husband has to file some separate application for divorce or getting his money back."

File a case of 420 on your wife on the basis of the agreement deal.

Hey Cool you mean to say police complaint for cheating. So will police entertain these sort of cases since its related to wife and husband. Or do husband need to directly file suit against wife in the court?
