Non paymeny of monthly salary

Hi frinds ,

I joined a Kolkata based Private Limited company on 30th May 2016 and they issue an employment letter accordingly . As per employment letter 7th of every month my salary to be paid, through June 2016 salary credited 11th July 2016.for the month of July 2016 salary be paid on 7th August 2016. MD of the company said (verbally) process of your salary may be delayed ,the reason he didn't explain and I also haven't asked for , on the 12th of August 2016 I wrote a mail to MD & Head of HR requesting to know my salary payment status . The same day they replied to be paid Saturday 13th August 2016. Due to my illness, I took a leave and inform over mail . On 16th August 2016 when I again ask for my salary they simply denied to pay and use, abuse word and said since my performance is poor so we your salary for the month of July 2016 will not be paid. During my tenure MD or HR department not issued any letter about my poor performance neither said verbally . Kindly advise me what to do now .

Did you record the abuses (audio/visual/witnessed/minuted)?

During work hours the employee is at the discretion of employer and wages for each day has to be paid.

 

You may ASAP firm up your next venture.

You have the option of consulting your own counsel specializing in Labor/Service matters and your counsel may opine to protest against abuses and demand apology and mention that you are at your known address till then and on job.

Or you can submit notice of resignation under protest.

What are your monthly wages?

YOu have mentioned your designation as 'Manager' under your name.

Is it glorified designation or you have powers to appoint, terminate, sanction ( not just recommend) leave/increment?

You have not replied to all points, pointwise.

Had you replied some inputs would have been possible.

You have the option of consulting your own counsel specializing in Labor/Service matters and your counsel may opine to protest against abuses and demand apology and mention that you are at your known address till then and on job.

 

Your counsel may opine that: If possible drive the discussion, rmind them of delayed and non payment of wages as per thier own dates given to you, thendeclinature to pay wages,abuses on dated..................and let them if they wish to contunue with abuses, and record.

Or minute from your end under proper acknowledgment and conclude that you were not allowed to come back to office and that you are at your address and would be deemed as present and eligible for wages.

 

Or visit office and close the matter as suitable to you and record.

 

Or approach the authority/forum/court of law  as applicable in your case as per various enactments that may apply in your case.
