They can challenge the second will which is there with the person who made the fake will.  It can be shown that that will is made under coercion, fraud, or the signature is fake and not of the testator.

HI SUCHITRA ,BUT HOW CAN WE PROVE THAT THE SIGNATURE IS FAKE ?

Why are the handwriting experts there for?  :)

I AGREE WITH U BUT MR"A" ONLY SIGHN ON THE PAPER AND NOT KNOW WHAT IS WRITTEN ON THE PAPER ?

IN THE SCENCE THE SON HAVE A SIGHNATURE OF MR"A" ON BLANK PAPER ?

THEN ???????????

Do you think handwriting experts cannot verify the validity of signature? Signature is also handwritten, right ? :)

VALIDITY OF SIGNATURE IS OTHER THING ?,

HIS SON CAN ASK AND SIGHN FORCELY BY MR"A" ON THE BLANK PAPER THEN WHAT SHOULD DO THE HAND WRITING EXPERT

Suchitra. S (Advocate)     08 June 2010

If he has decided to deceive, then he can do anything.. it is left to advocates to prove by facts and circumstances of the case, that the will is not original.  :)
