there is no law to get an attested affidavit by notary registered.Attestation to affidavit is proof of signatures of

executant of the affidavit

the notaries are practising advocates those are appointed as notary by central or state govt under provisions of Notaries ACT 1952 to do functions prescribed by them.

Answer: 1. yes oath should be in writing so others can know.

2. notary is responsible for one thing that the person who has signed before him must be the same person whose name and address are mentioned upon the document. usually advocates are identifies such person, or in absence of any advocate notary can identify him by his any valid identity proof like passport, election card, driving license etc.

In case any person refuses his affidavit, it can be proved before the Court. The Notary can be produced along with the said register t prove the attestation of the affidavit by notary.


The Notary is responsible that the person whoes name is appearing thereon should sign the same and also the contents thereof should be known to the person taking oath by way of affidavit.
