Notary marriage affidavit cum declaration

I want to ask you the experts,if a couple clicks the marriage photos only for sake of the affidavit from notary,without doing the rituals in due form as per hindu marriage act,1955.In the joint affedevit it is alleged that the marriage is performed with vaidik way,but the real fact it's not.If the girl moves to court for the annulment,can this said marriage be annuled,if its not performed and just the notary affedevit is seeked for protection purpose.Thankyou!

You have the right to file an application under section 11 of the HMA and seek anulment of your so called marriage.

I am of the view that no one should be allowed to take advantages of his/her own mistake. Her conduct amounts to an admission of the marriage and the principles of estoppel apply. Consider this, if a child is born out of such half bake solemnization of marriage, should the child lives with the trademark of b*st*rd? NO: Law must bends before the Majesty of Justice.
