Opinion

Company "X" is headquartered in Mumbai and its administrative office at Kolkata enters in to agreement with several vendors  for execution of business transaction in State 'Bihar". Clause states that in case of dispute, it will be under jurisdiction of court. Please advise jurisdiction of which court will be most appropriate :

Mumbai/Kolkata/Patna or State court of vendors.

Pl advise.

Mr.Jayant,

It is a standard practice to get signed the standarized form from the vendors buyt the question remains the place where the cause of action has arisen i.e. where any transaction has been carried out, any business transaction had been done, negotiated, correspondence exchanged etc. We have to see the facts in totality.

The case can be filed at the place where teh cause of action arose or where one of the respondent lives or carries on business for gains.
